Judgement in FBD pub Insurance Cases due today
A judgement is to be issued today, in the High Court in relation to actions taken by Dublin bars, Sinnotts Bar, The Leopardstown Inn, The Lemon and Duke and Sean’s Bar in Athlone, arising from FBD Insurance’ refusal to cover said bars, due to their business disruption, owing to the imposed covid restrictions.
The judgement was originally listed for January 2021, however the court reserved its judgement until today, to allow the parties time to make legal submissions, in support of their cases largely arising from a similar case in the UK.
This will be a significant ruling, as it is alleged that up to 1000 publicans will be affected by this ruling and the alleged declinature of indemnity for these publicans by their insurance providers.
At the same time, draft proposals, to recalibrate personal injury pay-outs and ultimately cap the level of damages (compensation), which can be awarded in Personal Injury claims, is being discussed by a cabinet sub-committee.
It is a significant time, in both the courts and insurance sectors, as both of these matters have the ability to significantly change the landscape into the future, in respect of personal injury awards and the criteria that is to be applied on determining such matters.
It is a hoped that a balanced approach and solution is arrived at , as to the ongoing and far reaching issues faced by all sides.
